
Terms and Agreements:
-- The following terms, conditions and information outline Service Provider’s
responsibilities (herein also referred to as "DJ", "ours",
"my" or "we") and the Customer/Client's responsibilities
(also herein referred to as "you", "yours" or "they").
This agreement is not binding until signed by the Client and Service Provider.
- The performance starting time is listed on the front of this contract. This
agreement guarantees that Service Provider will be ready to perform at the starting
time of the event. In most cases, Service Provider will arrive at least one
hour prior to the contracted time. However, no guarantee is made as to exact
time of arrival. Service Provider will perform at
- This agreement shall be excused by detention of sickness, accidents, death,
'Acts of God', or any other legitimate condition beyond Service Provider’s
control. In the unlikely event that the Service Provider is unable to appear/perform,
Service Provider will make every effort to find a qualified replacement at the
agreed upon fees. Should Service Provider be unable to find a replacement provider
of services, the client will receive a full refund. Further, in the unlikely
event that the Service Provider is delayed and/or the event does not start on
time or time is lost during the event by direct fault of the Service Provider,
Service Provider will refund the portion of the fees paid prorated to the time
lost. Client agrees that in all circumstances, Service Provider liability will
be limited to any balances paid and that Service Provider will not be responsible
for indirect or consequential damages. The Service provider is not liable for
any physical, body, or damage to event or venue; not liable for any circumstances
beyond our control
- Additional charges may be incurred for items including but not limited to
transportation expense for travel greater than 50 miles, supplies for certain
special effects, parking fees and hotel fees. Out of town events require an
additional travel time and meal expense fee. Rates do not include mileage for
out of town events unless listed which is concurrent with the Government rate
per mile, which covers the expense of gas, insurance, tire wear, and engine
wear. Out of town events require the client to pay the cost of the hotel room
in advance. Out of town event require an additional travel time and meal expense
fee. An in town event would be VA Beach, Norfolk, Suffolk, Hampton, Newport
News and the surrounding areas. An out of town event would be Richmond, Washington
DC., North Carolina, Etc
- When overtime hours are not negotiated at the time of the contract origin,
Service Provider cannot guarantee the availability to offer services past the
contracted time. If overtime is anticipated, Service Provider will make every
effort to accommodate the request. Overtime is payable either by cash or check
at the current rate for every hour with any incomplete hours being rounded off
in Fifteen-minute increments, which is due at the conclusion of the event in
addition to the contracted amount. The client or a representative party must
sign an overtime agreement prior to the Service Provider offering services past
the contracted time along with ensuring that the venue coordinator/venue representative
has also approved the request. Service Provider is not responsible for overtime
fees incurred by the client from the venue.
- The client agrees to maintain a safe environment as to protect the equipment
used from theft, vandalism and threat of harm or damage to the equipment used,
the Service Provider, and any assistant(s) to the Service Provider. The Service
Provider has the right to stop the performance and take the necessary steps
to secure him/herself, any assistant(s) and/or equipment, up to and including
removing equipment and leaving the event. In the event the Service Provider
believes an unsafe situation exists, the Service Provider may call upon the
Client to remedy the situation. If no action is taken, the Service Provider
may cease operation until the situation is resolved. Any theft or damage occurring
to any equipment/supplies owned by Service Provider because of negligent acts
of the Client or Client's guests will result in the Client being held responsible
to pay for the damages or lost items. Typical damages may include but are not
limited to alcohol spilled on equipment or music, the kicking or knocking over
of equipment or music, sprinkler/fire alarm damage, or the theft of music media
or equipment. Service Provider will notify the Client immediately upon discovery
of an accident or loss.
- In some instances the Client may be required to check with the chief engineer,
safety manager or an equally qualified representative of the venue/event location
to allow the use of such items including, but not limited to: fog/smoke machines,
bubble machines, confetti launchers or pyrotechnics. In these situations the
Client may also be required to sign a Statement of Responsibility form to acknowledge
that they have made all such arrangements. In the event the Client does not
the wish to sign the form, Service Provider reserves the right to not use such
items as part of the services contracted for the event. Karaoke, projectors/screens,
microphones, disco ball, strobe lights, fog machines, bubble machines, extra
lights, intelligent lights, trusses, and anything over 2 lights may require
an additional fee. DJ includes Professional CD players, audio mixer, 2 speakers,
stands, 1 amplifier and at least one microphone. DJ is not set up to run a soundboard
for a band or prepared for surprise guest performances.
- Payment for services will be accepted by cash or check only. Any balances
due can be paid for before, at the time of, or no later than right after the
actual event. The client agrees to pay a $25.00 service charge for all Insufficient
Funds checks. The total balance is due even if the Client or Venue decides to
end the function earlier than noted as the end time.
- No handwritten changes may be made to this contract unless both the Client
and Service Provider initial the changes as being mutually acceptable. Contract
addendums may be written up to address any changes regarding the event and any
changes must in writing and signed by both the Client and Service Provider.
However, Service Provider is not responsible for any changes made by the Client
within one week prior to the event.
- This contract agreement also serves as a non-disclosure agreement in which
the Client agrees not to discuss any terms and conditions related to this contract
with any past, current or future clients related to Service Provider.
- For outdoor events, the Client shall provide adequate protection for Service
Provider, assistants and equipment from sun and weather conditions.
- You, the Client do hereby agree to pay the total contract amount (as shown
on Form A) for the services provided by Service Provider. By signing this contract
agreement, the Client verifies that they have read and agreed with all terms
and conditions as presented.
- If the Service Provider is to make announcements of the guest, it is required
that the client provide the Service Provider with a list of names in advance
with any difficult pronunciations in Phonics. Last minute changes to the list
or the incorrect lining up of guest is not the fault of the Service Provider
- It is important to let the Service Provider know if the attire is a tuxedo,
barong, Hawaiian shirt, shirt and tie, etc.
- The Service Provider is not responsible to coordinate events; however, Service
Provider will attempt to coordinate small events, but client is advised to hire
a coordinator for larger events because the Service Provider has no control
over churches, limos, photographers, florist, videographers etc. The Client
should have some type of itinerary so that the Service Provider can provide
the best service available. It is up to the client to meet with the Service
Provider before the Event to insure satisfaction.
- It is required that if a certain song or songs which may cause good or bad
memories be stated ahead of time. If there is a song that should or should not
be played it must be discussed ahead of time. The same applies to games, line
dances, announcements, performances, etc. The Service Provider is willing to
discuss games and song suggestions with you. A song list will be provided at
your request.
- Formal events are weddings, proms, ring dances, Christmas parties, etc. Rates
are non-negotiable and competitive in the months of March, April, May, June,
Aug, Sept, Oct, Nov and Dec. These events are sometimes a small crowd but usually
a large crowd of people and require more expertise and equipment. Difficult
setups may incur an additional fee to pay for assistants. Small Mobile Gigs
are Senior Dances, Birthday parties and small non-formal events usually less
than 100 people without a very difficult setup. Small gigs are at the discretion
of the Service Provider and only acceptable if the area is safe
- The contract must be signed with a 50% deposit within 14 days to guarantee
service. Initial deposits are non-refundable, non-transferable and the final
balance is due no later than 1 week prior to the event or service will be cancelled.
Service provider, at their discretion, may refund deposits for customer satisfaction.
Contracted rates are non-negotiable. This agreement sets forth the entire agreement
between the parties relating to the subject matter hereof and stands in the
place of any previous agreement, whether oral or in writing. The parties agree
that no amendment to this agreement shall be binding upon the parties unless
it is in writing and executed by both parties. The parties acknowledge that
this agreement may be negotiated and transmitted between the parties by means
of a facsimile machine, email and that the terms and conditions agreed to are
binding upon the parties. Upon the terms being accepted, copies of the facsimile
or email will be validated by both parties forthwith. Service provider reserves
the right to document the event and use it for promotional purposes. Client
agrees that disputes will be settled by arbitration proceedings. Service provider
